Pursuant to the order duly entered by the Clerk of Superior Court of Wayne County on the 12TH day of September, 2012, the undersigned Commissioner will, on the 9th day of October 2012, at 11:00 o'clock A. M., at the Wayne County Courthouse Atrium offer for sale to the highest bidder for cash the following described real estate:
TRACT ONE: BEGINNING at a stake in the western edge of the right of way of U. S. Highway #117 at a point 100 feet S. 16-1/4 W. from the C. M. Frick corner on said Highway, and runs thence N. 76 W. and parallel with the Frick line 200 feet to a stake; thence S. 16-1/4 W. and parallel with the Highway 100 feet to a stake; thence S. 76 E. and parallel with the first line 200 feet to a stake in the Western edge of the right of way of U. S. Highway #117; thence N. 16-1/4 E. along the Western edge of said Highway 100 feet to the point of beginning, and being the identical property conveyed from Facie W. Weeks, et al, to James Henry Weeks by deed recorded in Book 741, Page 433, Wayne County Registry. And being the same property conveyed to Lloyd E. Davis and wife, Faye E. Davis by deed recorded in Book 917 at Page 410, Wayne County Registry.
This conveyance is made subject to any restrictions, rights of way and utility easements appearing of record in the chain of title, if any.
And being further identified by the Wayne County Tax Office by PIN 06 3601 37 8862 and being located at 3431 N. US 117 Hwy. Goldsboro, NC.
TRACT TWO: BEGINNING at an iron stake on the Western right of way of U. S. Highway No. 117, said stake being located N. 17-50 E. 510.82 feet from an iron stake at the most Northwestern intersectional corner of the Northern right of way of N. C. Secondary Road No. 1316 and the said Western right-of-way of U. S. Highway No. 117; thence from the beginning leaving said highway right-of-way with and beyond the line of F. W. Weeks, N. 74-45 W. 662.25 feet to an iron stake in the centerline of a ditch; thence with said ditch, N. 27-16 E. 102.14 feet to an iron stake at the intersection of said ditch and another ditch; thence with said other ditch and formerly C. M. Frick's line, S. 74-45 E. 648.50 feet to an iron stake at the intersection of said ditch and the said Western right-of-way of U. S. Highway No. 117; thence leaving said ditch with said right-of-way, S. 17-50 W. 100.00 feet to an iron stake, the point of beginning, containing 1.51 acres, more or less. And being the land conveyed to Facie W. Weeks by Margaret Ethel Howell Scott (Widow) by deed dated April 14, 1967, and recorded in the Wayne County Registry in Book 686, at Page 452, to which reference is hereby made. And being the same property conveyed to Lloyd E. Davis and wife, Faye E. Davis by deed recorded in Book 917 at Page 408, Wayne County Registry.
This conveyance is made subject to any restrictions, rights of way and utility easements appearing of record in the chain of title, if any.
And being further identified by the Wayne County Tax Office by PIN 06 3601 37 6936 and being located on N US 117 Hwy., Goldsboro, NC.
The highest bidder at the sale shall be required to make a cash deposit of 10% of the successful bid pending confirmation or rejection thereof by the Court.
