CONSENT ORDER
Town of Freemont, Post Office Box 4, Fremont, North Carolina 27830, EMC SOC WQ S12-005, Permit No. WQ0034102. Currently, the Town of Fremont is permitted to operate a 91,629 gallon per day wastewater treatment facility that irrigates treated effluent to land adjacent to Adcock Swamp, within the Neuse River Basin, classified Class C;Sw,NSW waters of this State. The Town of Fremont is unable to consistently comply with permit conditions, as set forth in Permit No. WQ0034102. Compliance will require preparation of plans and specifications for construction and operation of additional treatment works and/or modification of existing treatment works. The proposed Order contains a detailed schedule and stipulated penalties for failing to meet interim construction schedules and required deadlines. This proposed Order will expire on January 1, 2018.
On the basis of thorough staff review and application of Article 21 of Chapter 143, General Statutes of North Carolina, and other lawful standards and regulations, the North Carolina Environmental Management Commission proposes to issue a Consent Order to the persons listed above effective December 28, 2012 and subject to special conditions.
Persons wishing to comment upon or object to the proposed determinations are invited to submit same in writing to the Aquifer Protection Section Chief, 1636 Mail Service Center, Raleigh, North Carolina 27699-1636, no later than December 13, 2012. All comments received prior to that date will be considered in the formulation of final determinations regarding the proposed Order. A public meeting may be held where the Director of the Division of Water Quality determines that there is a significant public interest in a proposed Order.
